Validity
Valid for all services of JuKoTech GmbH – as of February 2026.
§ 1 Scope of application
(1) These terms apply to all contracts between JuKoTech GmbH (hereinafter "Contractor") and the Client concerning the planning, installation, maintenance and monitoring of HVAC systems, refrigeration technology and AI-supported control systems.
(2) These terms apply exclusively towards entrepreneurs (§ 14 BGB), legal entities under public law or special funds under public law.
§ 2 Scope of services & intelligent control
(1) The scope of services results from the written order confirmation. For optimisation the Contractor uses modern AI-based algorithms and remote monitoring (e.g. Siemens Building X).
(2) The availability of third-party cloud services lies outside the Contractor's sphere of influence. No liability is assumed for this.
§ 3 Prices and terms of payment
(1) All prices are exclusive of statutory VAT. Payments are due immediately upon invoicing without deduction unless another payment term has been agreed.
(2) Payment schedule: 50% on order, 30% on delivery of materials, 20% after commissioning. No early-payment (cash) discount may be deducted.
§ 4 Acceptance and transfer of risk
(1) Acceptance takes place formally after completion. The system is deemed accepted if the Client puts it into use or does not notify any significant defects within 12 working days of being requested to accept.
§ 5 Warranty
(1) The warranty period for installation services is 24 months. The respective manufacturer warranties apply to supplied components (e.g. heat pumps, sensors).
(2) Wearing parts are excluded from the warranty unless a maintenance contract exists.
§ 6 Remote access and data use
(1) To provide 24/7 monitoring the Contractor requires permanent remote access to the plant control. The Client provides a stable internet connection for this purpose.
(2) The recorded operating data is evaluated in anonymised form for optimisation and predictive maintenance.
§ 7 Retention of title
(1) The goods remain the property of JuKoTech GmbH until all claims have been paid in full. In the case of installation in buildings (essential component) the Client hereby assigns any claims from resale to the Contractor.
§ 8 Final provisions
(1) The law of the Federal Republic of Germany applies. Place of performance and jurisdiction is the registered office of the Contractor (Friedberg/Hesse).
